Acta Fit Privacy Policy

Effective 2026-10-18

This policy explains what information the Acta Fit iPhone and Apple Watch app, the actafitapp.com website, the Acta Fit AI connector, and the AI coach in the app collect, how we use it, who receives it, how long we keep it, and the choices you have. "We", "us" and "our" mean Bergie Industries LLC, the developer of Acta Fit (see Contact below).

The short version

Information we collect

Information that stays on your devices and in your iCloud

Workouts, sets, reps, weights, notes, templates, plans, training maxes, settings, and any profile details you enter (such as bodyweight, sex, or birth year) are stored in the app on your iPhone and Apple Watch. If iCloud sync is on, they are also synced between your devices through your private iCloud (CloudKit) database. Apple operates iCloud under its own terms and privacy policy; we cannot read your private iCloud database. What syncs through iCloud includes data read from Apple Health, such as heart-rate readings and time in heart-rate zones, and, for outdoor runs and rides, GPS routes that the app stores with your workouts.

Apple Health

Only with your permission, which you control in the Health app, Acta Fit reads from Apple Health: workouts (including workouts other apps such as Peloton, Runna or Strava saved there), heart rate, active and resting energy, body mass, biological sex, date of birth, workout effort scores, walking/running and cycling distance, and, on iPhone, workout routes (GPS), cycling and running power, speed, and cycling cadence. It writes your completed workouts to Apple Health, with heart rate, active energy, effort score, and for outdoor runs and rides distance and route. Data read from Apple Health is stored with your workouts as described above. It leaves your devices and iCloud only in these ways: (1) if you turn on Sync for your AI (below), heart-rate data and other workout metrics, including from workouts imported from Apple Health, are uploaded to our server; and (2) unless you turn usage analytics off, they record the duration and size of workouts you record, whether you rated a workout's effort (not the rating itself), and that an import from Apple Health ran. We never use Apple Health data for advertising or sell it.

Location

If you allow it, the iPhone app uses your approximate location (to about one kilometre) to show the weather on the Today tab; that location is sent to Apple's weather service (WeatherKit) and is not sent to us. During outdoor runs and rides, the Apple Watch app uses your precise location to record your route, which is saved to Apple Health and stored with the workout on your devices and iCloud. Routes are not part of the AI-sync copy. The temperature and humidity at the time of a workout are stored with it and are included in the AI-sync copy.

Your account

Acta Fit asks you to sign in with Apple when you first open the app, and the app is used signed in; your account is what ties your membership, device sync and any AI assistant you connect together. The web sign-in page used to connect an AI assistant also offers Google and email-and-password sign-in. We store a random user ID, your email address (from Apple this may be a private relay address), the name you share with the sign-in provider, your sign-in provider, a password in hashed form if you create one, and sign-in and confirmation timestamps. This is stored with our database and authentication provider, Supabase, on servers in the United States.

Sync for your AI (opt-in)

If you turn on Sync for your AI in the app's Account section (newer versions of the app label this setting "Connect your own AI assistant"; it is the same setting), the app uploads a copy of your training data to our Supabase database so that an AI assistant you connect can read it. The AI coach reads the same copy, and agreeing to the AI coach starts the upload if it is not already running. The copy includes, for each workout: date and times, title, status, exercises, sets, reps, weights, distances, durations, rest and pause periods, your notes, your effort score, heart-rate data (average, minimum, maximum, time in each heart-rate zone, and the series of heart-rate readings recorded during the workout), active calories, power data, speed, cadence, elevation, the weather at the time, and the name of the app that recorded a workout imported from Apple Health. It also includes your workout templates, plans, training maxes, and unit preferences. It is off by default. Signing out deletes the uploaded copy from our live database. Turning this setting off stops the app copying new training to our server. It does not disconnect an assistant you have already connected: that assistant stays connected until you remove our connector in the assistant itself. Turning this setting off also deletes the uploaded copy from our live database, unless you have agreed to the AI coach, which keeps using it: then the copy stays until you withdraw your agreement to the coach in Account or sign out, and it is deleted when this setting and the AI coach are both off (backups are described under "How long we keep information").

AI assistants you connect

Our AI connector uses the Model Context Protocol (MCP). It works with AI assistants that support MCP connections — for example Claude, ChatGPT where that assistant offers MCP connectors, and others. Not every plan or mode of those assistants supports connectors. You connect one by adding our connector in the assistant and approving it on our sign-in page. When you do:

AI coach

The AI coach is a chat in the Acta Fit app that you can type to or, if you choose, talk to. It is an AI. It is not a person, a doctor, a physical therapist or a licensed coach. It reads your training log and answers questions about your training, and it can suggest a plan, which changes nothing until you accept it in the app. Unlike an assistant you connect, we run the coach and use AI companies as our service providers. It is available only in the United States, only to people who are 18 or older (you confirm that when you turn it on), and only on accounts we have turned it on for. The first time you open it, the app shows a notice that says what it does with your information, and the coach does not start until you agree.

When you use the AI coach we collect and use:

Where it goes. Your messages and the training data the coach reads go from the app to our server (Cloudflare), which reads them from our database (Supabase), and then to the AI company that writes the reply, currently Anthropic. By default the coach's replies are read aloud by a cloud voice: the text of each reply goes through our server to a voice company, currently ElevenLabs, which turns it into speech. You can switch to an on-device voice at any time in the coach's voice settings; on-device voices send nothing. If the cloud voice is unavailable, for example when you are offline, the app uses an on-device voice instead. The notice you accept before the coach starts covers the voice company as well. These companies process the information for us to provide the service. Each keeps and handles its copy under its own terms with us, which can include a retention period of its own; deleting data from Acta Fit does not delete their copy.

How long we keep it. Your coach chats are kept on your phone until you delete them. A copy of a chat may also be kept on our server for a limited period for safety review; the notice in the app states that period before you agree. Facts the coach remembers are kept until you delete them. The record of your agreement, your usage totals and any safety flag are kept while you have an account. "Delete coach history" in Account deletes your chats on your phone and the facts the coach remembers. It does not delete the copy of your chats on our server straight away: that copy stays for the limited period above, and during that period we may be able to restore your chats if you ask. It keeps the record of your agreement, your usage totals and your safety flag, because deleting them would reset limits and safety checks. Withdrawing your agreement in Account stops the coach and deletes the server copy of your training from our live database unless the AI sync setting is also on. Deleting your account removes all of it from our live database. Backups are described below.

Who at Acta Fit can see it. We store coach information in parts of our database that the app and the public website cannot read, and the developer can open it. We do not routinely read coach chats. A person reads a chat only when you report a problem with it or a safety check flags it, or where the law requires it. We open the database otherwise only as needed to run, secure and fix the coach. The owner dashboard shows counts such as turns and cost, not what you or the coach said.

Improving the coach. We may analyze coach chats with names and contact details removed, using automated tools, including AI tools run by the companies that work for us, to understand common questions, how people feel about the answers and where the coach misunderstood, so we can improve it. The removal is automated and can miss something you wrote. We do not ourselves use coach chats to train AI models. What the companies that handle them for us do with their copy is set by their own terms with us, as described above. The results of this analysis are kept only in aggregate.

Analytics

Unless you turn them off, the app sends usage analytics to PostHog, whether or not you are signed in, to help us understand and improve it. Analytics are on by default: the first time you open the iPhone app it shows a notice that analytics are on, with a choice to turn them off, and sends nothing to PostHog until you have seen that notice. Your Apple Watch follows the choice made on your iPhone. You can change your choice at any time in Account → Privacy. Acta Fit is currently offered in the United States only. The analytics record:

The analytics do not include exercise names, weights, reps, your notes, or heart-rate values or other values from Apple Health, and they do not include what you say to the AI coach or what it says to you. Events from your Apple Watch are sent through your iPhone.

When you are signed in, these analytics are linked to your account. Turning analytics off stops new analytics from this device. Signing out stops new analytics from being linked to your account, but if analytics are on the app keeps sending them without an account. Neither turning analytics off nor deleting your account deletes analytics that were already sent to PostHog; you can ask us to delete analytics linked to your account (see Your rights).

Crash reports

The iPhone app always sends crash, hang and similar diagnostic reports to Sentry; there is no setting to turn this off. A report contains technical information: a random identifier for your installation, the error and stack trace (including the details of database errors), device model, operating system and app version, memory use, the internal storage path of the app's database, and a short trail of recent technical events (for example screens opened and the addresses of network requests the app made). We configure Sentry not to attach screenshots or to link reports to your account, and to remove email addresses and sign-in tokens, but a report can still contain fragments of whatever the app was handling when it failed. Sentry receives your IP address when a report is sent.

Website and waitlist

If you join the waitlist on actafitapp.com, we collect your email address, first and last name, how you found us (for example the referring page, campaign tags, or a partner's referral code), and your browser's user agent. Your IP address is used to limit abuse and, when enabled, is checked by Cloudflare Turnstile, a bot-protection service. If you are invited to the beta, we give your name and email address to Apple so TestFlight can send the invitation.

Support and beta feedback

If you email us, we keep the email and our reply. If you send feedback through TestFlight, Apple gives us your comment, any screenshots, your device and app version, and the email address Apple has for you. We use AI tools, currently Anthropic's Claude, to sort and summarize beta feedback and to help us investigate crash reports and analytics; those tools process the information involved on our behalf. Feedback summaries are kept in an issue tracker we run on our own equipment.

Server logs

Our hosting and database providers (Cloudflare and Supabase) automatically log requests to our servers, including IP addresses, times, and technical details of the request.

What the developer can see

We operate the database, so we have technical access to the information stored there, including the AI-sync copy, and we access it only as needed to run, secure, and support the service and to comply with law. The developer also uses an internal dashboard that shows, per user: name and email address (from sign-in and the waitlist), sign-up and sign-in times, membership and beta access status, the dates and times of workouts in the AI-sync copy, plan-proposal activity, and each AI-connector tool call (tool name, assistant, time and outcome). For each message you send the AI coach it also shows which AI model answered, how many tokens it used, what it cost and whether a reply was delivered, but never what was said. Those figures are kept only as long as the copy of your chat on our server (see "How long we keep it" under the AI coach). Analytics linked to your account show, per user, counts such as the number of workouts logged, plans created and AI-connector tool calls, and the analytics events listed above. None of this dashboard shows exercises, weights, reps, notes, heart-rate data or what you or the coach said.

How we use information

We do not use your information for advertising, we do not sell it for money, and we do not use it to track you across other companies' apps or websites. We do not make decisions about you that have legal or similarly significant effects based solely on automated processing.

Who receives information

How long we keep information

Deleting your account

You can delete your account in the app (Account → Delete Account). This deletes from our live database your account, profile, the AI-sync copy, plan proposals, exercise names, and the record of AI-connector calls, and AI coach information (chats kept on our server, remembered facts, the record of your agreement, usage totals and any safety flag), and it stops new analytics from being linked to you. It does not remove:

When you delete your account, the app asks you to confirm with Sign in with Apple so that we can revoke Acta Fit's Sign in with Apple link. If you skip that step, or Apple does not complete it, you can remove the link yourself in your Apple Account settings (Sign in with Apple). You can also export the data in your account from the app (Account → Export My Data) before deleting it.

Health information

Much of what Acta Fit handles — heart rate, calories, body mass, workouts, effort, and notes you write about training or injuries — is health information under some laws, including Washington's My Health My Data Act and similar laws in Nevada, Connecticut and other states. We collect it from you, your devices and Apple Health to provide the app's features and, with names and contact details removed, to improve the AI coach; unless you turn analytics off, we use workout events in analytics as described above; and we disclose it only to the service providers listed above, to the AI companies that run the AI coach, and, when you direct us, to AI assistants you connect. Notes you tell the AI coach about pain or injury, the facts it remembers and any safety flag are health information too. You can access or delete it, and withdraw consent, as described in Your rights. We are preparing the separate Consumer Health Data Privacy Policy that Washington law requires; we will link it here and on our website's home page.

Security

Information travels between the app, our website, our connector, and our providers over encrypted (HTTPS) connections, and access to our database is restricted by account. No system is perfectly secure, and we cannot guarantee the security of your information. If a breach affects your information, we will notify you and the authorities as the law requires.

Your rights

Depending on where you live, you may have the right to know what personal information we hold about you and access a copy; to correct it; to delete it; to receive it in a portable format; to withdraw consent; to opt out of the sale or sharing of personal information or its use for targeted advertising; to limit the use of sensitive information; and to appeal our decision on a request. We will not discriminate against you for using these rights.

You can export and delete your account data in the app. For anything else — including analytics linked to your account, your waitlist sign-up, or a full list of what we hold — email support@actafitapp.com. We may need to verify your identity, usually by confirming the email address on your account. You may use an authorized agent where the law allows. We respond within the time the law requires (for example 45 days in California). If we decline a request, you can appeal by replying to our decision, and if you are unhappy with the outcome you can contact your state attorney general or data protection authority.

Sale, sharing and targeted advertising. We do not sell personal information for money, and we do not share it for cross-context behavioral (targeted) advertising. We disclose it to the service providers above to run Acta Fit, and to AI providers only when you direct us to. If that ever changes we will update this policy first and offer the opt-outs the law requires. We treat a Global Privacy Control signal as a request to opt out of sale and sharing.

Do Not Track. Our website does not respond to browser Do Not Track signals; it does not track you across other websites.

California. In the past 12 months we have collected these categories of personal information, from you, your devices and Apple Health, for the purposes described above: identifiers (account ID, installation ID, email, name, IP address); internet and app activity (analytics, logs); approximate location; health and fitness information (sensitive personal information); account sign-in information (sensitive personal information); and inferences such as approximate location from IP address. We do not use sensitive personal information to infer characteristics about you. We do not disclose personal information to third parties for their own direct marketing.

International users

Acta Fit is offered only on the United States App Store. Acta Fit is operated from the United States, and our providers store and process information in the United States and other countries whose laws may not protect it as your home country does.

If you are in the European Economic Area, the United Kingdom or Switzerland, we are the controller of your personal information. We rely on: performance of our contract with you to provide the app, account, AI sync and connector; your explicit consent to process health information and to send it to an AI assistant you connect or to the AI companies that run the AI coach (you can withdraw consent at any time by turning off AI sync, removing our connector in the assistant, withdrawing your agreement to the coach in Account, or deleting your account); and our legitimate interests in security, crash diagnosis, and improving the app. Where we transfer your information outside your region we use safeguards such as the European Commission's standard contractual clauses or the EU–US Data Privacy Framework. You can complain to your local data protection authority. Because Acta Fit is not offered in the EU or UK, we have not appointed an EU or UK representative.

Children

Acta Fit is not intended for anyone under 16, and we do not knowingly collect personal information from children under 13. The AI coach is for people 18 and over, which you confirm when you turn it on. AI assistants have their own minimum ages. If you believe a child has given us personal information, contact us and we will delete it.

Changes

If this policy changes materially, the app will point to the updated version before the change takes effect, and the effective date above will change. We will not use information we already hold in a materially different way, or start sending your information to a new kind of recipient (for example an AI service that we host ourselves), without first asking for your consent where the law requires it. The AI coach asks before it reads your data for the first time, and if we add a new kind of recipient to it, the app asks again.
